TERMS AND CONDITIONS

Dear User, we wish to inform you that your personal data – collected directly from you – will be used by Azienda Agrituristica Bellavista in full compliance with the fundamental principles set forth pursuant to art. 13 of Legislative Decree 30.6.2003 no. 196 (hereinafter, "Privacy Code") and art. 13 of EU Regulation no. 2016/679 (hereinafter, "GDPR"), containing provisions for the protection of individuals and other subjects with regard to the processing of personal data.

We wish to inform you, pursuant to Article 13 of the Privacy Code (Legislative Decree 196/2003), that the processing of your personal data will be carried out fairly and transparently, for lawful purposes and protecting your privacy and your rights.

The processing will also be carried out with the aid of computer tools for the following purposes:

- To comply with the obligation set forth in Article 109 of Royal Decree 18.6.1931 no. 773, which requires us to register and communicate to the Police Headquarters the personal details of accommodated guests;

- To comply with current administrative, accounting, and tax obligations;

- To carry out the function of receiving messages and phone calls addressed to you;

- To speed up the registration procedures in case of your subsequent stays at our farmhouse;

- To send you our promotional messages and updates on rates and offers applied;

We would also like to inform you that providing your data for the purposes referred to in points 1 and 2 is mandatory, and if you refuse to provide them we will not be able to accommodate you in our agritourism.

If you wish for the processing referred to in points 3, 4, and 5 to be carried out, you will need to provide us with your consent.

Consent may, in any case, be subsequently withdrawn by objecting to the processing.

TEXT OF ARTICLE 7 OF THE PRIVACY CODE (LEGISLATIVE DECREE 196/2003) ON THE RIGHTS OF THE DATA SUBJECT REGARDING PROCESSING.

7. Right of access to personal data and other rights.

1. The data subject has the right to obtain confirmation as to whether or not personal data concerning him or her exist, even if not yet recorded, and to receive such data in an intelligible form.

2. The data subject has the right to obtain the indication of:

a) of the origin of the personal data;

b) of the purposes and methods of processing;

c) of the logic applied in the case of processing carried out with the aid of electronic tools;

d) the identifying details of the data controller, the data processors, and the representative designated pursuant to Article 5, paragraph 2;

e) of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as designated representatives in the territory of the State, as data controllers or processors.

3. The data subject has the right to obtain:

f) the updating, rectification or, when interested, integration of the data;

g) the deletion, transformation into anonymous form, or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;

h) certification that the operations referred to in letters a) and b) have been brought to the attention, including as regards their content, of those to whom the data have been communicated or disclosed, except in cases where this proves impossible or involves the use of means manifestly disproportionate to the right being protected.

4. The data subject has the right to object, in whole or in part:

i) for legitimate reasons to the processing of personal data concerning him/her, even if relevant to the purpose of the collection;

j) to the processing of personal data concerning him/her for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication.

1. The data subject or the person from whom personal data is collected is previously informed orally or in writing about:

a) the purposes and methods of the processing to which the data are subject;

b) the mandatory or optional nature of providing the data;

c) the consequences of a possible refusal to respond;

d) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as data processors or persons in charge, and the scope of dissemination of the same data;

e) the rights referred to in Article 7;

f) the identifying details of the data controller and, if appointed, of the representative in the territory of the State pursuant to Article 5 and of the data processor. When the controller has appointed several processors, at least one of them is indicated, specifying the website or the means by which the updated list of processors can be easily accessed. When a processor has been appointed to respond to the data subject in the event of the exercise of the rights referred to in Article 7, that processor is indicated.

2. The information referred to in paragraph 1 also contains the elements provided for by specific provisions of this code and may not include elements already known to the person providing the data or whose knowledge may concretely hinder the performance, by a public entity, of inspection or control functions carried out for purposes of defense or state security or for the prevention, detection, or repression of crimes.

3. The Authority may identify, by its own measure, simplified methods for the information provided in particular by telephone assistance and public information services.

4. If personal data are not collected from the data subject, the information referred to in paragraph 1, including the categories of data processed, shall be provided to the data subject at the time of the registration of the data or, when their communication is envisaged, no later than the time of the first communication.

5. The provision referred to in paragraph 4 does not apply when:

a) the data are processed on the basis of an obligation provided for by law, regulation, or community legislation;

b) the data are processed for the purpose of carrying out defensive investigations pursuant to Law 7 December 2000, no. 397, or, in any case, to establish or defend a right in court, provided that the data are processed exclusively for such purposes and for the period strictly necessary to achieve them;

c) the information to the data subject involves the use of means that the Authority, prescribing any appropriate measures, declares to be manifestly disproportionate to the protected right, or proves, in the opinion of the Authority, to be impossible.

5-bis. The information referred to in paragraph 1 is not required in the case of receiving CVs spontaneously sent by the data subjects for the possible establishment of an employment relationship. At the time of the first contact following the sending of the CV, the data controller is required to provide the data subject, even orally, with a brief information notice containing at least the elements referred to in paragraph 1, letters a), d), and f).
